Terms of Service

These Terms of Service ("Terms") govern your use of AnyAccent. They form a binding agreement between you and Guimin Zhou ("we", "us", "AnyAccent"), the operator of sandbox.anyaccent.com and the web application at sandbox.anyaccent.com/h5 (together, the "Service"). You accept these Terms by ticking the acceptance box at Paddle checkout, by signing in to the application, or by paying for any plan. If you do not agree with any provision below, do not use the Service.
1. Parties and structure
An AnyAccent subscription involves three parties. Their roles are summarised here because most provisions on this page depend on the structure:
- You — the individual using the Service. You sign in, record voice samples, use AI features, and pay for a plan.
- AnyAccent — the operator that builds and runs the Service. We hold service data (account, learning progress, chat history), determine the features included in each tier, and act as the data controller for that data. These Terms govern your relationship with us.
- Paddle (Paddle.com Market Ltd) — our Merchant of Record. Paddle is the seller of record for each transaction: it charges your payment method, calculates and remits applicable taxes, issues your invoice, and operates the customer portal through which you manage your payment method. Paddle's Checkout Buyer Terms govern the transaction itself.
You therefore have two contracts in parallel — one for the Service (these Terms) and one for the payment (Paddle's Buyer Terms). Refunds are the clearest example of why the distinction matters: Paddle decides and processes refunds under its Refund Policy as seller of record; we operate the Service-side account and can support eligible requests, but cannot move money on Paddle's behalf.
2. About AnyAccent
AnyAccent is a pronunciation-practice product covering 33 languages and the ability to switch accents within a single language — for example American versus British English, or Brazilian versus European Portuguese. Scoring is performed by a third-party speech-evaluation provider, and the chat, lookup, and translation features rely on third-party large language model ("LLM") providers.

3. Account registration
- Age requirement. You must be at least 13. In jurisdictions that require it (including parts of the EU), the minimum age is 16. Creating an account confirms that you meet whichever requirement applies.
- Sign-in. AnyAccent uses one-time codes sent by email. We do not store passwords.
- One account per individual. Subscriptions are individual. You may not share login codes, use a paid seat to serve multiple end users, or transfer an account to a third party.
- Account security. You are responsible for all activity under your account, including subscription charges. Notify us at support@anyaccent.com immediately if you suspect unauthorised access.
4. Subscriptions, billing, trial, and renewal
- Plans. Current tiers, included features, and prices are published at /pricing. Prices are quoted in US dollars. Each tier bills either monthly or yearly, in advance, at the price displayed on the date of checkout.
- Seller of record. Paddle, not us, is the seller of record. Your payment statement will show Paddle as the counterparty; Paddle issues each invoice, applies VAT, GST, and any other applicable taxes, and is the legal counterparty to the transaction.
- Acceptance at checkout. Paddle's checkout requires you to confirm that you have read and accept these Terms and the Refund Policy. That confirmation constitutes your acceptance. Continued use of the Service after a renewal constitutes ongoing acceptance.
- Free trial. Every new subscription begins with a 7-day free trial. No payment is taken during the trial. If you cancel before day 7, no charges will apply.
- Auto-renewal. After the trial converts, and at the end of each subsequent billing period, Paddle charges your payment method automatically at the then-current price for your plan and cycle. Paddle sends a reminder email before each annual renewal.
- Cancellation. You may cancel at any time from Settings → Manage subscription in the application, or from Paddle's customer portal (linked in every invoice email). Cancellation stops the next renewal — no further charge will be made — and you retain access until the end of the paid period.
- Refunds. Refunds are processed by Paddle as seller of record under the Paddle Refund Policy , which sets the applicable refund window (typically 14 days from the transaction date) in addition to any statutory right of withdrawal that applies where you live. The Refund Policy on our site sets out how to request a refund and how we support eligible requests.
- Price changes. If we change subscription prices, active subscribers will be notified by email at least 30 days before the new prices take effect. You may cancel before the change takes effect to avoid the new price.
- Failed payments. Paddle will retry a failed charge according to its own schedule. If the charge cannot be recovered, the subscription will be paused until the payment method is updated.
5. Description of the Service and limitations
AnyAccent records short audio samples on your request, streams them to a third-party speech-evaluation provider, and returns word-level and phoneme-level scores. The Service also offers chat, word lookup, and translation features powered by third-party LLM providers. The interface, prompts, lesson structure, accent-specific examples, and credit ledger are provided by us.
The Service is not:
- A certification or proficiency assessment. Scores are practice feedback only. They do not map to any official framework (CEFR, IELTS, HSK, ACTFL, or equivalent) and are not a substitute for a formal language examination.
- Speech-pathology or medical advice. For clinical speech concerns, consult a qualified speech-language pathologist. The scoring engine is general-purpose and was not designed for clinical use.
- Professional translation. AI outputs may be inaccurate, miss cultural context, or generate plausible-sounding but incorrect statements. For high-stakes use — including visa applications, legal filings, and medical instructions — engage a qualified human translator.
Features may be added, modified, or removed. Some features depend on third-party providers that we do not control. Where a change materially reduces the functionality of a paid plan, §12 applies.
6. Your content, voice recordings, and AI inputs
You retain all rights in the audio, text, and other materials you submit to the Service ("Your Content"). By submitting Your Content, you grant us a worldwide, non-exclusive, royalty-free licence to host, transmit, transform, and process it solely to operate the Service for you — for example, to transmit a recording to the speech-evaluation provider and return the result, or to relay a chat message to an LLM provider and return the reply.
Two clarifications specific to how the Service processes Your Content:
- Voice recordings. Audio is streamed to the scoring provider, scored, and discarded on our side. We retain the numeric scores; we do not retain the raw audio.
- Chat history. Retained for the window applicable to your subscription tier (between 7 and 30 days — see /pricing). A scheduled job deletes chat history outside the window.
AI-generated output ("Output") is provided for your personal practice. Because large language models may generate similar text for other users, we do not warrant uniqueness, nor do we warrant any intellectual-property rights in Output. You are responsible for determining whether a given Output is fit for your intended purpose.
You represent that you hold all rights necessary to submit Your Content, and that submitting it does not infringe any third-party right or violate any law.
7. Our intellectual property
The Service — including the AnyAccent name and logo, the website, the application code, AI prompts, lesson content, curated example sentences, the scoring methodology, and audio guidance — is owned by us or our licensors. Your subscription grants you a personal, revocable, non-transferable, non-exclusive licence to use the Service for your own practice. No ownership rights transfer to you.
Suggestions you submit are not confidential, and we may use them without owing you payment or attribution.
8. Acceptable use
You may not:
- Use the Service to violate any applicable law, or to infringe any third-party right.
- Submit content that is unlawful, harassing, defamatory, sexually explicit involving minors, or designed to deceive other persons.
- Bypass tier limits, credit limits, retention windows, or rate limits — whether by automation, multiple accounts, shared accounts, or reverse engineering.
- Scrape, crawl, or systematically extract content from the Service beyond what /robots.txt permits.
- Resell, sublicense, or white-label the Service or its Output without a written agreement with us. Contact us if a B2B arrangement is required.
- Probe the Service for vulnerabilities without first coordinating through support@anyaccent.com, or use the Service to attack any other system.
- Use the Service or its Output to train, fine-tune, or build a competing product, including by collecting Output as a dataset, running automated probes, or any equivalent activity.
We may restrict, suspend, or terminate access where we reasonably suspect a breach. For curable, low-severity breaches, we will ordinarily provide notice and an opportunity to cure before taking action.
9. Third-party providers
The Service relies on a limited set of third-party providers. The current vendor identities are available on request and are summarised by category in the Privacy Policy. The categories are:
- Paddle — payments and Merchant of Record. With respect to payment data, Paddle is an independent data controller, not our sub-processor.
- Speech-evaluation provider — pronunciation scoring.
- LLM providers — chat, word lookup, translation, and feedback. Routing depends on tier and feature.
- Transactional email provider — sign-in codes, receipts, and service notices.
- CDN and edge-security provider — content delivery, DNS, DDoS protection, and bot mitigation.
- Cloud hosting provider — application servers and database.
Each provider operates under its own terms and privacy practices. We select providers with care; we are not responsible for their independent acts or omissions.
10. Termination
You may stop using the Service at any time. Settings → Account → Delete account permanently removes the account. Cancelling a subscription is a separate action; both are documented in the application.
We may suspend, restrict, or terminate an account where we reasonably believe you have breached these Terms, violated applicable law, or created a risk to other users. For curable breaches, we will ordinarily provide written notice and an opportunity to cure before terminating.
Upon termination by us for material breach, amounts already paid are non-refundable except where mandatory consumer law requires a refund. Upon termination by you under ordinary circumstances, the Refund Policy applies. As described there, refunds are processed by Paddle as seller of record.
11. Disclaimers, limitation of liability, and indemnity
EXCEPT WHERE MANDATORY CONSUMER LAW PROVIDES OTHERWISE, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AND UNINTERRUPTED OPERATION, TO THE FULLEST EXTENT PERMITTED BY LAW.
WE DO NOT WARRANT THAT PRONUNCIATION SCORES REFLECT ANY EXTERNAL PROFICIENCY STANDARD, THAT AI OUTPUT WILL BE ACCURATE OR APPROPRIATE, THAT ANY SPECIFIC LANGUAGE, ACCENT, OR FEATURE WILL REMAIN AVAILABLE, OR THAT THE SERVICE WILL BE FREE FROM ERRORS OR DOWNTIME.
To the maximum extent permitted by law:
- NEITHER PARTY WILL BE LIABLE TO THE OTHER FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH LOSS.
- OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE IN ANY 12-MONTH PERIOD IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THAT 12-MONTH PERIOD, OR (B) USD 100.
Nothing in these Terms limits liability that cannot be excluded by law, including liability for death or personal injury caused by negligence, or for fraud.
You will defend, indemnify, and hold us harmless from any third-party claim, loss, or expense (including reasonable legal fees) arising from (a) your breach of these Terms, (b) Your Content or your misuse of the Service, or (c) your violation of any law or third-party right. We will give prompt notice of any such claim and may participate in the defence at our own cost.
12. Changes to the Service and these Terms
The Service evolves over time. We may add, modify, or remove features, including language and accent coverage. Where a change materially reduces the functionality of a paid plan, we will notify active subscribers and offer a pro-rata refund where mandatory consumer law requires.
We may update these Terms. The "Last updated" date at the top of this page reflects the current version. For material changes, we will give active subscribers at least 30 days' notice by email or in-app banner. Continued use of the Service after the change takes effect constitutes acceptance of the updated Terms. If you do not accept the change, cancel the subscription before it takes effect.
13. Governing law and dispute resolution
These Terms, and any dispute arising out of or in connection with them or the Service, are governed by the laws of the jurisdiction in which the legal entity named at the top of this page is registered, excluding its conflict-of-laws rules. The competent courts of that jurisdiction have non-exclusive jurisdiction over any dispute. Your right as a consumer to bring proceedings in the courts of your habitual residence, where local law confers that right, is preserved.
Before commencing legal proceedings, the parties agree to attempt informal resolution for at least 30 days by sending written notice to support@anyaccent.com stating the issue and the relief sought.
Disputes relating to the payment transaction itself — including unrecognised charges, chargebacks, and the mechanics of a refund — are also subject to Paddle's dispute process, given Paddle's role as seller of record.
To the extent permitted by law, the parties waive any right to participate in class actions, class arbitrations, or other representative proceedings against each other in respect of the Service. This waiver does not apply where prohibited by local consumer law.
14. Consumer rights take precedence
Nothing in these Terms reduces the rights conferred on you by mandatory consumer protection law in the jurisdiction in which you reside, including the EU Consumer Rights Directive, the UK Consumer Rights Act 2015, the Australian Consumer Law, the New Zealand Consumer Guarantees Act, California's Automatic Renewal Law, and equivalent regimes in other jurisdictions. Where local law provides a more favourable outcome than these Terms, that law applies. The disclaimers, limitation of liability, governing-law provisions, and class-action waiver above are subject to this principle.
15. General provisions
- Entire agreement. These Terms, together with the Privacy Policy and the Refund Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements on the same subject.
- Severability. If any provision is held unenforceable, the remaining provisions remain in force.
- No waiver. Our failure to enforce any provision on a given occasion does not waive our right to enforce it subsequently.
- Assignment. You may not assign these Terms without our prior written consent. We may assign them in connection with a merger, acquisition, or sale of assets, on notice to you.
- Force majeure. Neither party is liable for delays or failures caused by events beyond reasonable control, including third-party outages, natural events, and government action.
- Notices. Notices to us are to be sent to support@anyaccent.com. Notices to you will be sent to the email address on your account. Paddle may also email you regarding payment matters using the address it holds for your checkout.
- Language. These Terms are written in English. Any translation is provided as a convenience; the English version controls.
16. Contact
All correspondence with AnyAccent — including support, billing, privacy, and legal notices — should be sent to support@anyaccent.com. Marking the subject line with "Billing", "Privacy", or "Legal" helps with routing. The legal entity and registered address are stated at the top of these Terms.
Matters concerning the payment transaction itself — including statement queries, invoice questions, payment-method updates, and tax-document requests — should be directed to Paddle through the customer portal linked in every invoice email.
